The employer’s obligation to inform employees about the use of artificial intelligence under Swiss law

Swiss law already regulates workplace AI through labour law and data protection law, but AI strains existing duties. Employers must inform employees and, where relevant, consult representatives when AI systems process worker data, monitor performance, support HR decisions or create high risks. Even absent a fully automated decision, transparency may need to be enhanced. The employee’s access right remains central, but AI complicates explainability, erasure, legacy tools, updates and outsourced algorithmic management. Lire la suite
